Full proposal: Proposed Discharge of Conditions 3 5 and 6 of planning approval LA08/2020/1494/F. Condition 3 states - No development shall commence until a Final Construction Environmental Management Plan must be submitted by the appointed contractor to the planning authority. This should identify potential pollution pathways to adjacent watercourses and Montiaghs Moss SAC and mitigation measures to negate such risks. It should include Construction Method Statements for all works including details of the proposed culvert installation. The CEMP should incorporate all advice and guidance referred to by NIEA NED and WMU in consultation responses. The approved CEMP shall be adhered to and implemented throughout the construction period in accordance with the approved details unless otherwise agreed in writing by the planning authority. Condition 5 states - No development activity including ground preparation or vegetation clearance shall take place until it has been confirmed that there are no newts within the proposed area of the construction works by a suitably qualified and experienced Ecological Clerk of Works (ECoW) and the details roles and responsibilities of the ECoW have been agreed in writing by the Planning Authority and in accordance with the terms of a Wildlife Licence issued by the Northern Ireland Environment Agency. Condition 6 states - No development activity including ground preparation or vegetation clearance shall take place until a Construction Environmental Management Plan (CEMP) has been submitted by the appointed contractor to the planning authority for approval. The CEMP shall reflect the pollution prevention measures to be implemented in accordance with the submitted Outline Construction Methodology within the appendix of the Supporting Statement date stamped 30th November 2020 by Armagh City Banbridge and Craigavon Borough Council.
