Full proposal: Section 54 application to vary Conditions Nos. 7 and 8 of planning approval LA08/2021/0223/F (replacement of the existing wind turbine (51.5m hub height and 66.5m tip height) as approved in application Q/2012/0372/F with a V52 wind turbine up to 51.9m hub height and up to 77.9m tip height electrical cabinets hard standing area and all associated and ancillary works.) Condition no.7 shall be amended to read: “Within 21 days of a written request by the Council following a noise complaint which it judges to be reasonable from the occupant of a dwelling which lawfully exists or has planning permission for construction at the date of this consent the wind turbine operator shall at their expense employ a suitably qualified and competent person to assess the level of noise emissions from the wind turbine at the complainant’s property following the procedures described in pages 102-109 of ETSU-R-97.” Condition no.8 shall be amended to read: “The wind farm operator shall provide to the Council the independent consultant’s assessment of the rating level of noise emissions within 3 months of the date of the written request from the Council following a reasonable noise complaint unless otherwise agreed by the Council. The assessment shall include all data collected for the purposes of undertaking the compliance measurements and analysis.”
